1.Accepting these Terms
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use Monkita on behalf of a school or organisation, you confirm that you are allowed to accept these Terms for it.
2.Who can use Monkita
You must be at least 13 years old to use Monkita. If you are under 18, or under the age of legal majority where you live, you may use the Service only with the permission of a parent or guardian, who accepts these Terms on your behalf and is responsible for your use of the Service.
You may not use the Service if the law of your country prohibits it.
3.Your account
- You can sign up with an email address and password, or with Sign in with Apple or Google Sign-In. Please give accurate information and keep it up to date.
- Keep your sign-in details secure. You are responsible for activity that happens under your account. Tell us straight away at the address below if you think someone else has accessed it.
- One account is for one person. Do not share, sell or transfer your account.
- You can delete your account at any time in Profile, then Settings, then Delete account.
4.The Service
Monkita helps you learn languages with real videos, podcasts and books: tappable subtitles and words, practice modes such as shadowing, dictation, fill-in, role-play and AI chat, picture vocabulary decks, flashcards with spaced repetition, streaks and reminders.
Some features use artificial intelligence, including the AI tutor, translations, dictionary entries, transcriptions, pronunciation scores, generated audio and illustrations. AI output is generated automatically and may be inaccurate, incomplete or inappropriate. It is provided to help you learn and is not professional, academic, legal or medical advice. Please use your own judgement.
We keep improving Monkita, so features may change, be added or be removed. We may set reasonable limits on usage, such as the number of uploads or the amount of audio generated, to keep the Service fair and available for everyone.
5.Free plan and Monkita Pro
Monkita has a free plan and an optional paid subscription, Monkita Pro. The free plan includes the first lessons of each topic, one free book each day, one video of your own and daily vocabulary and flashcard limits. Monkita Pro unlocks every lesson, the whole book library, the AI tutor, unlimited vocabulary and flashcards, unlimited videos of your own and importing your own books. The following applies to Monkita Pro:
- Subscriptions are bought through the Apple App Store or Google Play and are billed by them to your store account. Prices, billing periods and any free trial are shown before you confirm the purchase.
- The yearly plan starts with a 7-day free trial for eligible new subscribers. You will not be charged if you cancel at least 24 hours before the trial ends; otherwise the yearly subscription starts and is charged when the trial ends. We send a reminder before your trial ends.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your account does not cancel a subscription.
- Refunds are handled by Apple or Google under their refund policies. Nothing in these Terms limits any right to a refund you have under consumer law.
- If we change the price of a subscription, we will tell you in advance and the store will ask for your consent where required.
6.Your content
"Your content" means the links, audio, video, book files, photos, text and messages you add to Monkita. You keep all the rights you have in your content.
So that we can run the Service, you give Monkita a worldwide, non-exclusive, royalty-free licence to store, copy, process, transcribe, translate, convert to audio and display your content, only to provide the Service to you and for as long as it stays in your account. This licence ends when you delete the content or your account, except for copies in backups that are deleted in the normal cycle.
You are responsible for your content. You confirm that you own it or have the rights and permissions needed to use it in Monkita, and that it does not break the law or anyone else's rights. Files and books you upload are for your own, personal, non-commercial study; do not upload material you are not allowed to copy.
7.Acceptable use
When you use Monkita, you agree not to:
- upload, share or ask the AI tutor to produce content that is illegal, harmful, hateful, sexually explicit involving minors, harassing, or that infringes intellectual property or privacy rights;
- use the Service to violate the laws of Vietnam or of the country where you are;
- try to access other users' accounts or data, or areas of the Service you are not authorised to use;
- interfere with or overload the Service, introduce malware, or get around usage limits or security measures;
- scrape, copy, resell or redistribute the Service or its content, or use it to build a competing product or train AI models;
- reverse engineer the app, except where the law expressly allows it;
- impersonate someone else or misrepresent your connection with any person.
8.Third-party content and services
Monkita lets you learn from content made by others, such as YouTube videos, podcasts and public-domain books. That content belongs to its creators and is subject to their terms. When you use YouTube content through Monkita, you also agree to the YouTube Terms of Service, and Google's Privacy Policy applies.
We are not responsible for third-party content or services, and including them does not mean we endorse them. Links to other sites are provided for convenience.
9.Our intellectual property
The Service, including the app, website, design, mascot, illustrations, decks, lessons, software and the Monkita name and logo, belongs to Monkita or its licensors and is protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own learning, in line with these Terms. All rights not expressly granted remain ours.
If you send us feedback or ideas, we may use them freely without any obligation to you.
10.Copyright complaints
We respect intellectual property rights. If you believe content in Monkita infringes your copyright, email support@monkita.app with: your contact details; a description of the work and of the content you believe infringes it, with enough detail for us to find it; a statement that you believe in good faith the use is not authorised; and a statement that the information is accurate and that you are the rights holder or authorised to act for them. We will review the request, remove or disable the content where appropriate, and may suspend repeat infringers.
11.Suspension and termination
You can stop using Monkita and delete your account at any time. We may suspend or close your account, or remove content, if you seriously or repeatedly break these Terms, if the law requires it, or to protect users or the Service. Where reasonable, we will tell you first and explain why. If we discontinue the Service, we will give you reasonable notice.
Sections that by their nature should survive termination, such as content licences for backups, intellectual property, disclaimers, limitation of liability and governing law, continue to apply.
12.Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available". We work hard to keep Monkita accurate, secure and available, but we do not guarantee that it will be uninterrupted or error-free, that content or AI output will be accurate, or that you will reach a particular level or result. Nothing in these Terms excludes guarantees that cannot be excluded under consumer protection law.
13.Limitation of liability
To the extent permitted by law, Monkita will not be liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or 1,000,000 VND (or the equivalent in your currency).
These limits do not apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud, and they do not affect your statutory rights as a consumer.
14.Indemnity
To the extent permitted by law, you agree to compensate Monkita for reasonable losses and costs, including legal fees, arising from content you upload or from your serious breach of these Terms or of the law.
15.Changes to these Terms
We may update these Terms when the Service or the law changes. We will post the new version here with a new date and, for important changes, tell you in the app or by email before they take effect. If you keep using Monkita after the changes take effect, you accept the new Terms; if you do not agree, you can delete your account.
16.Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam. If you have a problem with Monkita, please contact us first at support@monkita.app; most issues can be resolved quickly this way. If a dispute cannot be resolved through negotiation within 30 days, it will be settled by a competent court of Vietnam.
If you are a consumer living in another country, you also keep the protection of the mandatory laws of your country and may bring a claim in your local courts where that law allows.
17.App Store and Google Play
If you downloaded Monkita from the Apple App Store or Google Play:
- These Terms are between you and Monkita only, not Apple or Google. Monkita, not Apple or Google, is responsible for the app and its content.
- Your licence to use the app is limited to devices you own or control, as allowed by the store's usage rules.
- Apple and Google have no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the app.
- Monkita, not Apple, is responsible for handling any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims and intellectual property infringement claims.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18.General
If any part of these Terms is found to be unenforceable, the rest stays in effect. If we do not enforce a right straight away, we do not give it up. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation or sale of the Service. These Terms are available in several languages. If a translation differs from the English version, the English version prevails, except that the Vietnamese version prevails for users in Vietnam.
